Terms & Conditions

Orders accepted by Conservatory Doctor hereinafter referred to as ‘the Company’, are subject to the following Conditions of Contract.

  1. General
    In these conditions ‘the Company’ is the company named and any company, person or firm dealing with ‘the Company’ is referred to as ‘the Customer’
    Items described in the description of works or other items are the subject matter referred to in the matter as ‘the goods’;
    (b) The company enters into all agreements with the Customer solely on the terms of these conditions and no representation or warranty collateral or otherwise shall bind the Company and no statement made by any Representative of the company shall vary these conditions unless such representation, warranty or statement shall be made in writing and signed by a Director of the Company and shall be stated to be made specifically in pursuance of clause
    (1b) of these conditions and shall be in respect of this contract only.
  2. Materials
    The Company uses the best materials obtainable but does not undertake that they will be free from minor imperfections resulting from the process of manufacture.
  3. Customer Rights
    The rights of the customer under these terms and conditions are in addition to and not in substitution for any rights conferred by common law or by statute.
  4. Existing Installations
    If necessary, the Customer shall at his own expense remove or re-set prior to installation any gas, electrical or plumbing installations and connections and arrange for any telecommunication equipment to be re-sited.
  5. Disturbances
    Following the installation of goods the Company does not undertake to restore or match the state of decorative repair where this has been unavoidably disturbed during installation.
  6. Time and Performance
    Whilst the Company will undertake all reasonable endeavours to complete the installation by the date quoted, the time for installation given is not of the essence of the contract.
  7. Access
    The Company will notify the customer of the date of installation ensuring the customer has adequate notice in which to obtain the balance owing. The Customer will permit the company access within normal working hours on such a date or on such other week day as may be notified by the Company being the date within the following 21 days
  8. Payment
    The balance of the purchase price is payable on completion of the installation.  Payment is to be made to the installer in cash, or by cheque, or by Credit Card in favour of the Company.  The Company reserves the rights to charge interests based on a monthly rate of 2.75%, calculated on a daily basis and invoiced weekly on any balance remaining outstanding after installation.
  9. Resale of Goods
    The Goods ordered by the Customers are manufactured specifically for the Customers own requirements and, as such, cannot be re-sold by the Company to parties other than the Customer.
  10. Cancellation
    Once the Contract has been signed, it is legally binding and is not subject to cancellation.
  11. Vat
    VAT is applicable to all contracts and the customer undertakes to pay the VAT at the rate set by the government at the time of installation.
  12. Consequential Damage
    The Company accepts no responsibility for any damage resulting from any structural or any other defect in the property at which the installation is carried out.
  13. Contract Terms
    The Contract contains all the terms which have been agreed and no representation or promise oral or in writing not confirmed on this form shall be binding on either party.
  14. Improvements
    The Company’s policy is to continue to develop and improve and therefore reserves the right to vary the design/or specification of any installation without prior notice to the customer.
  15. Company’s Rights
    Any Concessions latitude or waiver allowed by the Company at any time shall be without prejudice to their strict and full rights under this contract and shall not prevent the Company subsequently exercising such rights.
  16. Alterations to Contract
    Any alterations to any part of this contract document including these terms and conditions, invalidates these contracts.
  17. Passing of Property
    All Goods shall remain the property of the Company until the total price inclusive of any interest due thereon in accordance with these conditions be paid by the customer.
  18. Terms
    The terms set out above will be the terms governing the contract between the Company and the Customer.
